EZSchoolAlert Terms of Service
Content
The content created on the EZSchoolAlert website is created by people whom EZSchoolAlert exercises no control. EZSchoolAlert will not assume responsibility for unintended or questionable content delivered via the EZSchoolAlert service.
Disclaimer of Warranties
EZSchoolAlert disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information displayed in the email or text message. EZSchoolAlert disclaims any responsibility for the deletion, failure to store, miss-delivery, or untimely delivery of any information or material. Due to the nature of email services and individual cell phone providers, EZSchoolAlert cannot guarantee the successful delivery of messages.
Voluntary Use
School administration and staff, who generate messages, use EZSchoolAlert on a voluntary basis. EZSchoolAlert is not responsible for the creation of messages or decisions to create and send messages to the user base. EZSchoolAlert staff will make a follow up effort with the district if complaint reports arise due to lack of timely input of alerts.
No Spam
Only messages created by the user specified group may be delivered to the user. No unsolicited messages generated by any third party will be permitted to be distributed via the EZSchoolAlert service.
If at any point, you wish to opt out of our services, you may do so via your account page or by calling (608) 237-7124.
Registered User Information
Registered user information of the EZSchoolAlert service will not be sold to third parties.
Limitation of Liability
UNDER NO CIRCUMSTANCES WILL EZSCHOOLALERT OR ITS EMPLOYEES, OFFICERS OR DIRECTORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICES WHETHER OR NOT EZSCHOOLALERT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnity
You agree to indemnify, defend and hold harmless EZSchoolAlert, its parent company (VPR, LLC), its employees, officers and directors, or Clients from and against any and all claims, liabilities, penalties, settlements, judgments, fees (including reasonable attorneys' fees) arising from (i) any content that you or anyone using your account may submit, post or transmit to the web site; (ii) your use of the Services; (iii) your violation of the terms of these Terms and Conditions; and (iv) any violation or failure by you to comply with all laws and regulations in connection with the Service.
EZSchoolAlert Addendum
Length of Use
A registered user account on the EZSchoolAlert website is good for one full year (365 days). If a user wishes to unsubscribe themselves from the EZSchoolAlert service they may contact us to do so at any time.
Other Plan Specific Terms
These terms entitle the user to the following:
(1)One year’s (365 days) use of the EZSchoolAlert service for as many email and cell phone numbers a user registers.
(2)The ability for a user to add, update or delete any phone or email address at any time.
(3)The ability to cancel a user account at any time.
Other Charges
Your cell phone service provider may charge you for the text messages you receive. EZSchoolAlert will not be liable for any charges you may receive from your cell phone provider for receiving text messages from EZSchoolAlert.
Bouncing Emails
In order to provide the best possible service to all of our users, we may remove EZSchoolAlert users whose email is regularly rejected, or "bounced". Mail is usually rejected by remote mail servers because the destination email address is no longer valid.
Timely Delivery of Email and Text Messages
Sending email and texts can be a complicated process, and there can be many reasons for delayed delivery or even failed delivery. We will do our best to make sure that this does not happen, but due to the nature of email servers and cellular phone technology we cannot guarantee delivery.
